Most likely. They are saying that some of the code might not make it
into the public, but I think that refers to code like the SGI EFS/XFS
code that still isn't available to AFS source licensees.

Even though it's much easier to understand what's going on
protocol-wise if you have the source, I'm not sure that this is the
biggest obstacle for Milko.
